Lane Closures Scheduled in Lower Salford Township - October 9 - 12

As announced by PennDOT: on Sunday, October 9, through Wednesday, October 12, from 6:00 PM to 6:00 AM the following morning, a lane closure is scheduled on Fretz Road between Wambold Road and Yoder Road; Yoder Road between Fretz Road and Clemens Road; Clemens Road between Yoder Road and Ruth Road; and Ruth Road between Clemens Road and Route 63 (Main Street) for paving and base repair.


Updated Frequently Asked Questions to Proposed Sale or Lease of the Sanitary Sewer System

An update has been made to the Frequently Asked Questions - Proposed Sale or Lease of the Sanitary Sewer System Document available on the Sanitary Sewer System Valuation Section of the Township's website. The full document can be found here, while the latest addition is features below. 

The new Q&A content include numbers 16, 17 and 18 relating to:

  • NextEra recapturing the $115.3 million purchase price via consumer rates
  • If the Township can terminate the sewer system sale without cause,
  • Clarification on termination consequences should the sewer sale be prevented by intentional Township action or inaction via a home rule charter.

18.  Are (a) unilateral, intentional Township action or inaction as a home rule charter preventing the sewer system sale; and (b) a formal Township termination of the APA without cause, the same in terms of possible legal and financial consequence?

Yes. It’s been suggested that the Township, as a home rule charter, could somehow avoid the significant consequences of breaching the APA if the sewer system sale is stopped with certain Township action or inaction by way of the charter’s provisions—such as repealing the sale-authorizing ordinance or constraining the Township from fulfilling the APA—as opposed to a formal Township termination of the APA without cause. This is not legally accurate. In terms of applicable legal and financial consequence, they are one and the same. They both would constitute a breach of the APA.

Specifically, any unilateral, intentional, formal or informal, action or inaction, taken by the Township, as a home rule charter preventing the sewer system sale without cause is a breach of the APA. Such a breach carries with it all the potentially significant legal and financial consequences for the Township (as described above in FAQ 17). Consequences could include specific performance (i.e., the court stepping in and ordering the sale of the sewer system as intended under the APA) and/or money damages against the Township for the breach possibly in excess of tens of millions of dollars.


Board of Supervisors – October 12th Meeting

The next Board of Supervisors Meeting is this Wednesday, October 12 at 7 pm. This meeting will be held in the Meeting Hall of the Municipal Complex, located at 1090 Troxel Road, Lansdale. The meeting will also be streamed online via Zoom, for residents unable to attend in person, but wish to watch and/or hear the meeting.  Zoom links are provided on the Township website and Facebook page.

Public comments may be submitted in advance for those who can not physically attend the meetings or made in person. For those unable to attend in person, submit your public comment to info@towamencin.org until 4:30 pm the day of the meeting and your comment will be read at the beginning of the meeting.

Budget Work Session Schedule: October 19 & November 2  (7 pm)

As part of the annual budget process, the Board of Supervisors will meet with various Township departments and committees over the next month to review their budget presentations. Meetings will be held in person-only (no Zoom streaming) at 7 pm in the Meeting Hall of the Municipal Complex located at 1090 Troxel Road, Lansdale, PA.
